Austin Criminal Lawyer
Frequently Asked Questions
Can a jury acquit me even if I broke the law?
Yes. The jury has the power to decide whether or not a person is guilty of a crime. Even if jurors think a person committed a crime, they can still free him or her. This is called “jury nullification” and it is very rare. This power allows a jury to nullify a law and so then the person hasn’t committed a crime. It is most commonly seen in cases with a political twist to them, such as draft dodgers during the Vietnam War not being convicted.
