Criminal Law
Criminal law, also called penal law, is a term that references any of a number of various bodies of rules in different jurisdictions, including state and federal jurisdictions, whose one similar characteristic is that the punishment for any of these can result in unique and often severe penalties should a person fail to comply with the various statutes. This area of law is commonly enforced by a government of some sort, rather than civil law which is commonly enforced by private individuals. Criminal punishment can include execution, imprisonment, probation, and monetary fines of varying amounts.
The areas of criminal law include homicide, fraud, RICO, DUI, drug charges, sex offenses, homicide, and assault and battery, to name a few. Many of these things can be either a federal or a state crime. They are commonly both. In general, the crimes do not change from one court system to another. They commonly have similar penalties as well.
Criminal law violations can be prosecuted in both misdemeanor and felony courts. These courts prosecute different crimes based on their severity. Often, a first offense crime that carries a misdemeanor can become a felony on subsequent charges and convictions for the same crimes.
